PRIVACY POLICY

Black Whale Lighting is committed to protecting your privacy. Black Whale Lighting will only use your phone number and email to contact you in case of an update or problem with the fulfillment or delivery of your order. The email address online you provide is used only to provide you with an order confirmation and tracking number. You must request online to be included in our email newsletters or marketing promotions. You reserve the right to opt-in to our mailing list(s) and have the ability to opt-out at any time. If you have any questions or concerns regarding our privacy policy, please contact us so we can address them.

WARRANTY

Black Whale Lighting does not provide warranties on the products offered for sale on this website. All lighting products, however, are sold with a manufacturer warranty which warrants that products sold to the first non-dealer purchaser will be free from defects in material and workmanship. If a product does have a defect, Black Whale Lighting's obligation is expressly limited to replacement, without charge, or repair at the factory after prior written return authorization has been granted. Black Whale Lighting's obligation under this warranty does not extend beyond the initial cost of the product and accordingly any consequential damages or labor costs arising out of a defect are expressly excluded. This warranty shall not apply to products that have been altered or improperly used. Notice of a defect must be received by Black Whale Lighting within one (1) year from the date of purchase. All complimentary light bulbs included with the fixtures are exempt from this warranty.

CANCELLATION POLICY

Black Whale Lighting attempts to process orders as soon as they are submitted, and we cannot accept changes or cancellations for orders that have already been processed.

PRICE MATCH GUARANTEE

At Black Whale Lighting, you can shop with confidence that you are receiving the best prices anywhere by shopping with us. If you find the same exact product advertised for less by one of our competitors within 14 days of your purchase, we will gladly match that price. CA sales tax will not be considered in price matching as it is the purchasers' legal responsibility to pay sales tax to the state even when the retailer does not collect it. Please note that our Price Match Guarantee applies only to the identical product from the same manufacturer. The competitor must be an authorized dealer of the product and it must be a stock item, available for shipment and not on extended back order. A website link or written quote from the competing vendor for the same product(s) shipped to the same address must be sent to Black Whale Lighting. Shipping and handling will be factored in to determine final price. Price Match Guarantee does not apply to clearance items, floor models and select manufactures. Other restrictions may apply. RETURNS & REPLACEMENTS

Black Whale Lighting strives to provide customers with the best customer experience on the web and offers a very convenient replacement and return policy. The details of the policy are listed below and our dedicated staff is always available to help during business hours.

Black Whale Lighting works to provide a hassle-free return process. Products may be returned under the following conditions:

The customer must notify Black Whale Lighting within 14 days of receipt of the delivery that they wish to return the product. Returns cannot be accepted 15 or more days after delivery. Customers must notify us via email at sales@blackwhalelighting.com. We will confirm receipt of your notice within 48 hours. A customer service representative will provide you with instructions for returning the product using a Return Goods Authorization number. Returns will not be accepted without a Return Goods Authorization number.

The product must be in its original packaging, must not show signs of installation (no cut wires or scratches), and must be in resalable condition.

The product must not have been part of a custom order, purchased from our clearance section, or discontinued by the manufacturer. We cannot accept light bulb returns. Custom orders include all manufacturers who provide finish/glass options or make product to order. This includes manufacturer lines such as Hubbardton Forge, Kalco and Fine Art Lamps. This also includes any product where a non standard lamping is specified, generally all fluorescent fixtures. Please feel free to clarify before ordering whether your item is returnable or not.

Customers will be responsible for return shipping and a 20% restocking fee. These charges will be deducted from the original purchase price before a credit is issued.

To return an item, please send an email to sales@blackwhalelighting.com for a return authorization number. After a Return Authorization is requested, we will:

Issue an RGA number (return goods authorization number) and provide an address for you to use to ship the products.

Issue credit within 30 days of the manufacturer receiving and inspecting the product.

Once a product has been received, we will work to provide credit to customers as quickly as possible. Again, returns by the manufacturer will not be accepted without an authorization code on the returned fixture.

Credits will not be issued for products damaged during shipment, and you will be responsible for filing a claim with the shipper. Therefore, it is recommended to insure all return shipments and provide us with tracking information.

EXCHANGES & REPLACEMENTS

To replace an item please send an email to sales@blackwhalelighting.com for a return authorization number. After a Return Authorization is requested, we will:

Issue an RGA number (return goods authorization number) and provide an address for you to use to ship the products.

Once the item is received by the manufacturer, they will notify us that it has been received and inspected. At this point, they will process the replacement order for the item. If you need the replacement expedited, you will need to purchase the replacement fixture so it can be submitted immediately. Credit for the returned fixture will occur once we have been notified by the manufacturer that the damaged fixture has been received and accepted by them.

Most manufacturers do not reduce return fees for product exchanges. Please contact Customer Service via phone or email to sales@blackwhalelighting.com to inquire about exchange options. We will respond to your email within 48 hours.

REFUSED ORDERS

If the product is refused upon delivery or returned without an RGA number (return goods authorization number) to the manufacturer, the customer will be responsible for any charges incurred. The customer will be responsible for the manufacturer's restocking fee which may be up to 25% of the purchase price of the item; as well as both initial and return freight charges.

REPLACING DAMAGED OR DEFECTIVE PRODUCT

Black Whale Lighting will replace damaged, defective, or broken products and glass, free of charge, under the following conditions:

The customer must notify Black Whale Lighting of the product's defect via email to sales@blackwhalelighting.com, within 14 days of delivery. If you do not notify us about broken, damaged, or defective goods within 14 days of delivery, we cannot replace them free of charge.

We will confirm receipt of your notice within 48 hours. A customer service representative will provide you with instructions for returning the product using a RGA number (Return Goods Authorization number). Replacement requests will not be accepted without a Returns Good Authorization number.

Damaged, defective, or broken products must be received and inspected by Black Whale Lighting or the manufacturer before a replacement is issued.

If you discover damaged products upon opening a shipment and decide not to accept delivery, please contact Customer Service immediately to take appropriate action to resolve the matter. We will respond to your email within 48 hours. A claim will be filed with the carrier to credit your account for the damaged fixture, which we will replace at no cost. If the damaged product is repairable with replacement parts, these parts will be shipped at no cost. Black Whale Lighting will not be responsible for expedited shipping of any replacement parts or products. If the replacement product is back ordered extensively, we will retrieve the damaged product or instruct you to discard it and issue a credit for the item.

SHIPPING POLICY

We offer free regular ground shipping on all items with a selling price of $99 or more. $8 per item will be added for items selling under $99. This offer is only valid for the continental United States. Orders shipping outside the continental United States or items needing expedited shipping will incur additional costs.
